KİRACIYA İHTAR NASIL ÇEKİLİR ? Kiracıya çekilecek ihtarname bazı koşullarda noter aracılığıyla çekilmek zorundadır. Kiracı isterse sözleşme süresinin bitiminden 15 gün önce bildirimde bulunarak çıkabilir. Belirsiz süreli kira sözleşmelerinde, 10 yıllık süre geçtikten sonra uzayan yılların bitiminden 3 ay önce bildirimde bulunarak çıkarılabilir. Aksi takdirde çıkarılamaz.

Ihtar çekilen kiracı ne yapmalı?

Kiranın ihtarnamenin tebliğinden sonra ödenmesinin önemi olmayıp, ihtarnameye sebebiyet verme yeterlidir. İhtarların çekildiği kira yılının bitiminden itibaren 1 ay içinde, kiracı tahliyesi için dava açılmalıdır. İki haklı ihtar ile kiracının tahliye edilebilmesi için ihtarların haklı nitelik taşıması gerekir.

Kiracı 7 gün içinde itiraz etmez ve 30 gün içinde de ödemeyi yapmazsa mal sahibi İcra Mahkemesi'ne yapacağı başvuru ile tahliye talep edebilir. Mal sahibi ihtarname gönderdikten sonra tahliye davasını Sulh Hukuk Mahkemesi kanalıyla da talep edebilir.
