Takip talebinde bulunmak icra takip işlemi değildir. Bu yüzden talik(erteleme) hallerinde de takip talebinde bulunulabilir. Takip talebi icra dairesine 'yazılı' , 'sözlü' veya 'elektronik ortamdan' yapılabilir. Takip talebi harcın ödendiği tarihte yapılmış sayılır.

Takip işlemleri Örnek 1 nolu takip talebi ile icra dairesine başvurulması ve başvuru masraflarının ödenmesi ile başlamaktadır. Bono ( Senet), poliçe, çek, fatura, sözleşme, mahkeme kararı ve sair belgelerle ya da belgesiz icra takibi başlatmak için ofisimizim icra avukatı departmanından avukatlık hizmeti alabilirsiniz.

Takip talepleri nelerdir?

İcra takibinin ilk aşamasını oluşturan takip talebi, alacaklının icra dairesine başvurarak alacağının tahsil edilmesi amacıyla koyduğu idaredir. Takip talebi icra dairesine yazılı veya sözlü olarak ya da elektronik ortamda yapılır.


Takip talebini kim hazırlar?

Faturayı düzenleyen kişinin icra dairesine sunacağı Takip Talebi ile icra takibi başlatılır. Bu takibin dayanağı olan fatura da takip talebinin ekinde yer almalıdır. Takip Talebi kendisine ulaşan İcra Dairesi ise takip talebine uygun olarak 7ÖRNEK ÖDEME EMRİ hazırlar.

Takip talebi nereden yapılır?

İcra dairesine talep; yazılı, sözlü veya elektronik olarak yapılabilir. İcra takibini alacaklının kendisi yürütebileceği gibi avukat da yönetebilir. İcra takibini başlatmak için borçlunun yaşadığı yerleşim bölgesindeki icra dairesine başvuru yapılır.

Takip talebi ne zaman başlar?

Takip talebi harçların ödendiği tarihte yapılmış sayılır. Yargıtay'a göre daha önce temerrüde düşmemiş olan borçlu takip talebinde bulunulması ve ödeme emrinin tebliği ile temerrüde düşer.

Örnek 7 Takip talebi nedir?

Yalnızca para teminat alacaklarına ilişkin olarak başlatılan ve Örnek No:7 şeklinde düzenlenen ödeme emirlerine ilamsız takiplerde ödeme emri denir. Ödeme emri; alacaklı tarafından takip talebinin icra müdürlüğüne sunulmasının ardından icra müdürlüğü tarafından düzenlenen belgedir.

Takip talebi ne zaman kesinleşir?

Genel haciz yolu ile başlatılan ilamsız icra takibinde borçlu, icra dairesi tarafından kendisine gönderilen ödeme emrine 7 gün içinde itirazlarını bildirirse, takip durur. İtiraz süresi içinde itiraz edilmezse ödeme emri ve icra takibi kesinleşir. Çünkü yedi günlük süre hak düşürücü süredir.

Örnek 13 Takip talebi nedir?

Kiraya veren alacaklının takip talebini icra dairesine vermesi üzerine tahliye talebini alan icra müdürü, tahliye talebini de içeren bir ödeme emri düzenleyerek üç gün içinde borçluya gönderir. İcra dairesinin düzenlediği bu ödeme emri, Örnek No: 13 olarak da adlandırılmaktadır.

Haciz yolu ile takip iki şekilde başlatılabilir: ilamsız takip, ilamlı takip. İlamsız takip türleri ise 4 tanedir. Bunlar: genel haciz yolu ile takip, kambiyo senetlerine mahsus haciz yolu ile takip, kiralanan taşınmazların tahliyesine özgü takip ve abonelik sözleşmesine özgü haciz yolu ile takiptir.
