İşçi hangi durumlarda ihtar çekebilir?

İşçi, alamadığı hakları için işyerinden ayrılmak istiyorsa işyerine ihtarname çekebilir. Maaşlarını alamayan işçiler, işyerine hak ve taleplerini ihtarname çekerek isteyebilirler. İşçi, işyerinden haksız yere çıkarıldıysa iş yerine ihtarname çekebilir.

İşçi ihtarname nasıl çekilir?

Yasal olarak hazırlandıktan sonra noter aracılığı ile ihtar çekilmelidir. İhtarname hazırlanırken öncelikle işverenin adı, soyadı ve açık adresi açık şekilde belirtilmelidir. Sonrasında ise aynı bilgiler işçi için yazılmalıdır. Bu aşamadan sonra ihtar konusu hakkında detaylara yer verilmelidir.

Ihtar çeken işçi ihbar tazminatı alabilir mi?

İhtarname, birçok durumda çekilebilir ve taraf için birçok avantaj sağlar. Fayda sağladığı birkaç konu şu şekildedir; İşçi, işverene sunacağı ihtarname ile fazla mesai alacağı, hafta tatili, ücret alacağı, kıdem tazminatı, ihbar tazminatı gibi haklarını talep edebilir.

Noterden ihtarname çektikten sonra , ihtarname muhataba ulaştıktan sonra ihtarnamede öngörülen süre içerisinde ihtar konusunu oluşturan eylem yerine getirilmezse (ödeme yapılması, haksız fiilin sonlandırılması gibi) hukuki yollara başvurulacaktır. İhtarnamedeki beyanlar ilerideki olası bir dava sürecinde bağlayıcıdır.

İşçi ihtar yerse ne olur?

Bu bakımdan işçiye “davranışı” ile ilgili nedenlerle “ihtar” verildiği zaman işçinin “savunmasının alınmaması” ihtarı “geçersiz” kılmaz; ama, “savunma alınmadan” işçinin iş sözleşmesinin “davranışı veya verimi” ile ilgili nedenlerle feshi “geçersiz” olur.

Avukatsız ihtarname çekilir mi?

Avukatsız ihtarname çekmek mümkündür. İhtarname işlemleri noter aracılığıyla da yapılabilir. Ancak bu alanda uzman bir avukat ile ihtarname çekmek hak kayıplarını önleyecektir. Örneğin; ihtarnamenin içeriği oldukça önemlidir.

İşveren ihtarnameye cevap vermezse ne olur?

İhtara cevap verilmezse ne olur? Gönderilen ihtara cevap verme zorunluluğu yoktur. Kişi ihtara cevap vermediğinde ihtara konu iddiaları reddetmiş sayılmayacağı gibi kabul etmiş de sayılmaz.

İş piyasası ve işten çıkarma prosedürleri hakkında bilinen yanlışlardan biri olan 3 ihtar ile işten çıkarma yapılabileceğidir. Aslında net bir sayı verilebilen bir konu değildir. İhtar sayısına bağlı olarak iş çıkışının yapılması durumu belirli bir hüküm ile uygulanan bir mesele değildir.

Noterden ihtarname çekmek ne işe yarar?

Noterlik Kanunu Yönetmeliğinin 98. maddesinde ihtarname "kanun, sözleşme, örf ve adetten doğan hak ve isteklerin yazılı şekilde bildirilmesi veya haber verilmesi için yapılan işlemler" şeklinde tanımlanmıştır.

6 ay ile 1,5 yıl arası görev yapan işçiler, 4 haftalık ücret tutarından tazminat alır. 1,5 ile 3 yıl arası çalışan işçilere ihbar tazminatı 6 haftalık maaş tutarında ödenir. 3 yıldan fazla görev alan işçi ise 8 haftalık ücret tutarında tazminat ödemesi alır.

İşverene noterden ihtar nasıl çekilir?

Uygulamada sıklıkla yaşanan kafa karışıklığı arasında ihtar çekildikten sonra ihtarname işyerine ulaşana kadar çalışmaya devam edilip edilmeyeceği hususudur. Cevap net: İşçi derhal fesih hakkını kullanmış ve ihtarname çekmiş ise ihtardan sonra ise gitmemelidir.

Ihtar çeken işçi işe gitmek zorunda mı?

Fakat bu süreler içinde cevap vermemeniz, hukuk düzenince susma, ikrar yani iddiaları kabul etme anlamı taşımadığından aleyhinize olumsuz bir hukuki sonuç doğurmayacaktır. Bu nedenle tarafınıza gönderilen ihtarnameyi cevaplamamanız durumunda kabul etmiş sayılmayacaksınız.
