Türk Borçlar Kanunu'nda sözleşmeler, kural olarak, hiçbir şekle bağlı değildir. Diğer bir ifadeyle, kanunda kendisi için bir şekil kuralının öngörülmediği bir sözleşmenin taraflarca sözlü, yazılı veya resmi şekilden herhangi birinin tercih edilmesi suretiyle yapılması mümkündür.


Sözleşme metni nedir?

Sözleşme, birden fazla kişinin hukuki bir netice oluşturmak amacıyla belirli bir konu üzerinde vardığı anlaşmadır. Sözleşmeler yazılı olabileceği gibi sözlü de olabilir. Ancak ispat kolaylığı açısından her zaman yazılı sözleşme türü nü tercih etmek yerinde olacaktır.

Bir sözleşmenin geçerli olması için tarafların sözleşmeyi özgür iradeleriyle ve bilinçli olarak yapmış olmaları gereklidir. Sözleşmenin kurulabilmesi için sözleşmenin taraflarından birinin yönelttiği sözleşme yapma teklifinin diğer tarafın kabul etmesi gerekir.

Kagit uzerinde sözleşme geçerli mi?

Türk ve İsviçre hukuk sistemlerinde sözleşmelerde şekil özgürlü- ğü ilkesi geçerlidir.
